Freak Workouts Terms of Use

These Terms of Use (“Terms”) govern your use of Freak Workouts, provided by The Freak Company, LLC(“The Freak Company,” “we,” “us,” or “our”).
By downloading, accessing, creating an account, starting a trial, purchasing a subscription, or using Freak Workouts, you agree to these Terms. If you do not agree, do not use the app.
1. Eligibility and account
You must be at least 13 years old, or the higher minimum age required where you live to use the app independently. If you are under the age of legal majority, a parent or legal guardian must review and accept these Terms and supervise your use.
You sign in through Sign in with Apple. You are responsible for protecting your Apple account and devices, maintaining accurate account information, and notifying us of suspected unauthorized use. You may not sell, transfer, or share your Freak account.
2. The service
Freak Workouts allows you to create and record workouts, exercises, muscle groups, sets, repetitions, loads, duration, training volume, and performance history.
The app requires an active Freak Workouts subscription or eligible trial for premium tracking and editing features. A Freak Workouts subscription applies to Freak Workouts only unless the purchase screen expressly says otherwise.
3. Subscriptions, trials, and payment
Freak Workouts offers auto-renewing monthly and annual subscriptions.
- The intended United States price is USD $4.99 per month or USD $29.99 per year.
- Eligible users may receive a 14-day free trial on the annual subscription.
- Prices, currency, taxes, billing period, trial availability, and renewal terms shown by Apple at checkout control.
- Payment is charged to your Apple Account when you confirm the purchase.
- Your subscription automatically renews unless you cancel it at least 24 hours before the current billing period ends.
- Apple may charge your account for renewal within 24 hours before the current period ends.
- Trial eligibility is determined by Apple. Unless you cancel before the trial ends, the applicable paid annual subscription begins automatically at the price displayed at purchase.
Apple manages billing, renewals, cancellations, price-change notices, and refund decisions. RevenueCat validates purchase status so the app can grant access.
You can manage or cancel through your Apple Account subscription settings or the in-app subscription-management option where available. Cancelling stops future renewals but normally does not end access during an already-paid period.
Deleting the app or your Freak account does not cancel an Apple subscription. Cancelling a subscription does not delete your account or workout data.
4. Restoring purchases
You may use Restore Purchases in the app to restore eligible purchases associated with the relevant Apple Account. Access is provided when Freak Workouts receives a valid active entitlement.
5. Fitness and health disclaimer
Freak Workouts is a personal fitness tracking tool. It is not a medical device, healthcare provider, personal trainer, diagnostic service, treatment service, or emergency service.
The app does not diagnose, treat, cure, prevent, or monitor disease or injury. Workout recommendations, calculations, charts, progress records, and training-volume measurements may be incomplete, inaccurate, or unsuitable for you.
Consult a qualified healthcare professional before beginning or materially changing an exercise program, especially if you are pregnant, have an injury, medical condition, or health concern. Stop exercising and seek appropriate medical care if you experience pain, dizziness, chest pain, or other concerning symptoms. In an emergency, contact local emergency services.
6. Your data
You retain your rights in the content and data you create in Freak Workouts. You grant us a limited, worldwide right to host, process, copy, transmit, calculate from, and display that data only as needed to operate, secure, support, and improve the app and comply with law.
You are responsible for ensuring that your data and use of the app are lawful. Do not upload unlawful, malicious, or infringing content.
Our handling of personal information is described in the Freak Workouts Privacy Policy.
7. Acceptable use
You may not:
- Use the app unlawfully or violate another person’s rights.
- Access another person’s account or data.
- Interfere with the app, its security, Firebase, RevenueCat, Apple services, or subscription verification.
- Reverse engineer, decompile, modify, distribute, rent, lease, sell, or sublicense the app, except where law expressly permits it.
- Circumvent subscription checks, manipulate receipts, misuse refunds, or obtain access without authorization.
- Upload malware or use automated tools to scrape or extract substantial portions of the app or its content.
8. Availability and changes
The service depends on your device, internet connection, Apple, Firebase, RevenueCat, and other systems outside our control. We do not guarantee uninterrupted, error-free, or universal availability.
We may update, improve, replace, suspend, or discontinue features. We may change subscription offerings or prices through App Store Connect, subject to Apple’s requirements and applicable law. We will not intentionally remove paid access during an active paid period except where necessary for security, fraud prevention, legal compliance, or serious operational reasons.
9. Intellectual property
Freak Workouts, including its software, design, text, trademarks, and other materials provided by us, is owned by The Freak Company or its licensors and protected by applicable intellectual-property laws.
Subject to these Terms and Apple’s applicable license terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Freak Workouts on Apple-branded devices you own or control.
10. Third-party services and Apple terms
Freak Workouts uses services from Apple, Google Firebase, and RevenueCat. Their services are governed by their respective terms and privacy policies.
These Terms supplement Apple’s Standard Licensed Application End User License Agreement and Apple Media Services Terms. If these Terms conflict with mandatory Apple terms concerning App Store licensing or billing, the applicable Apple term controls.
Apple is not responsible for providing support or maintenance for Freak Workouts. The app is provided by us, not Apple. Apple and its subsidiaries are third-party beneficiaries of the Apple-related provisions of these Terms.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law, Freak Workouts is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted availability, and error-free operation.
Nothing in these Terms excludes rights or remedies that cannot legally be excluded.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunity arising from your use of the app.
Our total liability for claims relating to Freak Workouts or these Terms will not exceed the greater of: (a) the amount you paid for Freak Workouts in the 12 months before the event giving rise to the claim; or (b) USD $50. This limit does not apply where prohibited by law.
12. Governing law and disputes
These Terms are governed by the laws of Georgia, without regard to conflict-of-law rules. Mandatory consumer-protection laws in your place of residence remain unaffected.
Courts located in Tbilisi, Georgia have jurisdiction, subject to any mandatory consumer-protection law that gives you the right to bring a claim elsewhere.
Before bringing a formal claim, you and we agree to attempt to resolve the matter informally by email for at least 30 days, unless urgent relief is needed.
13. Changes to these Terms
We may update these Terms to reflect changes in the app, subscriptions, service providers, or law. We will update the effective date and provide additional notice where required. If you do not agree to updated Terms, stop using the app and cancel future renewal before the next billing date.
